Terms and Conditions
By accessing and using www.palomadresshire.com, you are accepting and consenting to the practices outlined in these terms and conditions. This is a legally binding contract between Paloma Dress Hire and the client. Paloma Dress Hire reserves the right to change these terms and conditions at any time without notice to you. "we", "our", "us" means Paloma Dress Hire. "Client" ("you", "your", "their") means the client. "RRP" means "Replacement Value".
01 Paloma Dress Hire's Commitment to you:
We will deliver the product that you have ordered including the correct size, colour, and style on or before the date you have specified for delivery on your order. Except where we have indicated to you that your request for this is not possible or guaranteed and therefore your order has been amended.
02 Garment Condition:
Paloma Dress Hire strives to provide quality and cared for garments, however please be mindful that this is a dress hire business. All garments have been worn more than once unless they are brand new. Some items may have general signs of wear, such as but not limited to: minor staining, pulling, loose threads, etc., that do not affect the wearability of the garment and are not cause for a refund.
In the unlikely case that you receive a damaged garment from us, please contact us immediately with photos as proof. You lose the right to dispute the matter and a potential refund if we are not contacted within 4 hours of garment collection/delivery. If we believe the garment qualifies for a refund, the garment must be returned on the same day, unworn.
You lose the right to a refund and/or your bond back if you fail to return or post your garment back within the same day of collecting/receiving it.
03 Bookings:
Hire bookings are not secured until full payment has been made. Enquires and try on appointments do not reserve/hold garments for your selected date. Garments cannot be collected without full payment being made. A standard booking period is 4 days, this includes the pickup day and return day.
04 Cancellation & Refund Policy:
Once an item has been paid for, we have a strict no-refund policy. If you wish to cancel your booking, you must contact us immediately. A store credit note may be available for unusual circumstance, this requires proof and is at the discretion of Paloma Dress Hire. A store credit note is valid for 6 months. Postage fees are non-refundable in all circumstances.
If your order is cancelled on behalf of Paloma Dress Hire, you will be refunded the total amount minus any Shopify, Afterpay or Paypal transaction fees.
05 Item Collection:
Local pickup:
Local pickups are located in Tarragindi, Brisbane. Collection of the garment is organised by the client with us. It is the client's responsibility to organise a pickup time, collect their garment, and organise a return time. If your garment is not collected, you will not be given a credit note or refund.
Postage:
Australia-wide express postage is offered via Australia Post. Paloma Dress Hire is not liable for any delayed, lost or damaged deliveries by Australia Post, if the garment is sent by us in the recommended time frame for delivery. In the case of late delivery due to Australia Post, a credit not will be issued. To qualify for a credit note, the garment must be sent back the same day as delivery. If the garment is returned after your event date, you will not be issued a credit note.
It is the client's responsibility to collect the package on their end and to make sure the delivery address is correct and secure. If the item goes missing due to an incorrect address or an un-secure location being provided, the client will be liable to pay late fees and/or the Recommended Retail Price ("RRP") of the garment. A store credit will not apply in this circumstance.
06 Returns:
Local pickup:
Garments are to be returned to the collection location in Tarragindi, Brisbane on the last day of your agreed booking period by 6PM. Do not leave garments unattended at the premises without permission. It is your responsibility to arrange a time with us before coming.
Postage:
Garments must be returned in the provided express return parcel by 3PM on the last day of your agreed hire period. The parcel must be lodged at your local post office with a lodgment receipt to send to Paloma Dress Hire as proof of postage.
Late fees will apply at $15 per day, these are applicable to incorrectly posted items. If the garment is not returned within 4 days of the end date of your booking, Paloma Dress Hire reserves the right to charge you another hire fee. These time frames apply to every client unless another return time is discussed prior to booking. Garments must be returned via the same method as collection.
07 Garment Care & Cleaning:
By making a booking with Paloma Dress Hire you agree to handle and treat our garments with the upmost care. This includes following any additional care requests for particular garments, e.g. not wearing jewellery with garments that have particularly delicate fabric. If you're chosen garment has particular care requests it will be written on the listing of that particular garment.
Do not make any adjustments to your outfit that could damage the item e.g. pinning it/adding stitches, etc. Do not steam or iron your garment without permission from us. Garments are not to be taped without permission from us. If the garment is damaged but repairable, you are liable for these repair costs. Do not wash or dry clean your garment.
All of our garments are carefully hand-washed by us using cleaning products of our choice. If you have sensitivity to particular cleaning products it is your responsibility to contact us before booking your hire.
If your garment is returned extensively stained/marked/ripped, your deposit will not be refunded. After damage occurs, it is at Paloma Dress Hire's discretion to decide whether a garment is still hireable or not. In the case that a garment cannot be repaired or restored to its original condition, Paloma Dress Hire reserves the right to charge you the RRP of the garment. The RRP is available to see on the listing of your particular garment.
08 Damages & Replacement:
In the case of damage, loss or theft, Paloma Dress Hire reserves the right to charge the client fees, up to and including 100% of the RRP of the garment. The RRP is available to see on the listing of each garment. The fees charged will be at our discretion, depending on the situation. RRP and compensation fees are to be paid in addition to fees already paid - original hire cost and the deposit are not deducted from the RRP.
In the case that a client is required to pay these fees outlined, they will have the option to pay in full or via a payment plan of either weekly or fortnightly. The weekly or fortnightly payment costs are at the discretion of Paloma Dress Hire. The client is able to keep the garment they have paid to replace, after full payment has been received.
If a garment is stolen or the client refuses to pay the fees outlined by Paloma Dress Hire within 14 days, their details will be forwarded onto debt collectors to retrieve the costs. Should this be the case, the client will be liable for any extra costs/commissions involved in the debt collection process. Additionally, a police report will be filed.
09 Sizing & Try Ons:
A $15 non-refundable fee is required to book a local try on appointment with us. The fee is redeemable towards the hire fee of your chosen garment, but, non-refundable for unsuccessful try-ons, cancellations and no-shows. The fee is redeemable for up to 30 days after your appointment date. To redeem the try on fee to hire hire, you must message us for the discount code. If you fail to do this, the $15 will not deducted and will not be refunded if you enquire after paying for your hire.
It is your responsibility to try on your garment before booking your hire. If you choose to book a hire without trying your garment on and it does not fit, you will not receive a refund. If you have booked with pickup, you may be eligible to swap your hire with a different garment of ours if time and availability allow. This does not apply to postal hires.
10 Deposits/Bonds:
A deposit is required with every hire booking with us. The deposit is refundable if the garment is returned in good condition. It is not refundable if the garment is returned in a condition that requires professional cleaning, a seamstress, etc. It is up to Paloma Dress Hire's discretion as to what qualifies as 'returned in good condition' and what results in your deposit being held. If we are not going to refund your deposit, we will be in contact with you.
11 ID Verification:
Garments with a replacement value above or equal to $500 or particularly delicate garments, require a photo of the front and back of the clients ID. This must be sent to us via direct message on instagram prior to postage or pickup. The garment will not be posted or pickup address will not be given until this information is received by us. Failure to provide this information in time for us to post the garment for the clients event or to provide the pickup address before the clients event will not result in a refund or store credit. If the client is underage, a parent/guardian's ID must also be sent. Photos of IDs are not stored beyond the completion of the hire period.
